If the reality is as you mentioned,
it is not permissible for Waqf land to be inherited and divided among heirs, even if the purpose for which the Waqf was granted has been changed. This land has to remain as a Waqf and its income should be spent on charitable matters that need money spent on them, but do not have other sources of income, such as on repairing, restoring, and building Masjids (mosques) or providing water and furniture for them; providing public utilities that people living in this area are in need of; giving Sadaqah (voluntary charity) to the poor, especially to the relatives of the donor of the Waqf; and so on. May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
