Zakah on the grains shared by partners


A : 1. The Zakah on crops is due when the grains are dry and it should be paid on the entire harvest. Each partner should be responsible to pay the Zakah due on his share and if one of them makes a condition that the other must pay all the Zakah from his share, the condition will be effective and valid, because Zakah allows deputization.2. The mentioned wage, which is 6% of the harvest, is not included in Zakah and should be deducted from the harvest before the payment of Zakah, because the reaping process is a means of sifting and preparing the harvest for use.3. What the first party spent, e.g. The sum mentioned above, is of his own money and should not be deducted before the payment of Zakah; rather the Zakah should be on the whole of his portion of the harvest.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
