Q: My husband passed away and left no inheritors except me. I want to make a will from his estate and from my money which I inherited from him. What is the ruling on this?


A: Your prescribed share of inheritance is a fourth of what he left and the rest of his estate belongs to his `Asabat (agnate heirs). If he has no relatives, the matter shall be referred to the Shari`ah court. However, you are allowed to bequeath a third or less of your property.May Allah grant us success.
