Fulfilling the will from one third of the estate only even if the entire estate was bequeathed

A: It is permissible to bequeath one third, or less than that, as (Part No. 16; Page No. 301) a suitable property for Waqf. The revenues of this Waqf should be spent on charitable activities such as the maintenance of Masjids (Mosques), Sadaqah (voluntary charity) to poor relatives and others. If any of your children or grandchildren is poor, they may take from this revenue. On the other hand, the rest of your property should be distributed among the heirs, for the Prophet (peace be upon him) ordered Sa`d ibn Abu Waqqas to do so. May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
