Divorcing one's wife while she is pregnant

Q: I divorced my wife one time while she was pregnant. After she gave birth to a baby girl, both of us now wish to return to each other in marriage. I appreciate your advice.


A: If the reality is as you have mentioned, that you divorced your wife while she was pregnant then she delivered, it will be permissible for you to return to her after concluding a new marriage contract with a new Mahr (mandatory gift to a bride from her groom) (Part No. 20; Page No. 236) and the wife's consent because she ended the period of `Iddah (woman's prescribed waiting period after divorce or widowhood) by delivery as long as you have not divorced her for the third time. But if this is the third time of divorce, she will not be lawful for you unless she gets married to another husband, consummates marriage with him then gets divorced and her `Iddah passes. Only then can you return to her in marriage. May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
