Q: A dispute arose between my sister and her husband who drove her out of the house. Having stayed in her parents' house for four days, her husband came to my father seeking to reconcile with his wife. As a result, my mother took an oath that my sister should not return to his house unless he would pay her ten thousand riyals. I talked with my sister and her husband about the cause of the clash. I found that it was simple and judged that her husband should pay one thousand riyals only to take his wife.
However, my mother intentionally took another oath that he must pay ten thousand riyals.
I convinced her to ask about the ruling on the oath she took. It is noteworthy that my sister wants to (Part No. 23; Page No. 99) return to her husband's house. Please answer us. May Allah reward you with the best!
A:
If your sister returns to her husband's house before her husband pays ten thousand riyals, the oath taken by your mother will thus be broken. Your mother, therefore, will have to offer Kaffarah (expiation) for an oath, which involves feeding ten Miskins (needy persons), or clothing them, or emancipating a believing slave. If she cannot afford any of them, she must observe Sawm (Fast) for three days.May Allah grant us success. May peace and blessings be upon our Prophet Muhammad, his family, and Companions.
