Q: My father died eighteen years ago. He was buried in a
Christian
cemetery in
France.
Is it permissible for me to exhume his body out of that cemetery and rebury his remains in the graveyards of (Part No. 7; Page No. 392) Muslims? It is worth mentioning that before his death he instructed me to bury him in
Algeria,
but at that time I had no money nor could I devise any other plan to execute his will.
A:
It is not permissible
to bury a Muslim person in the cemetery of the Kafirs (disbelievers). But, if it so happened, his remains should, by any means, be exhumed and moved to the graveyard of Muslims, if they have one there. Else, he should be moved to any other place void of any grave of the disbelievers.May Allah grant us success. May Allah's Peace and Blessings be upon our Prophet Muhammad and his family, and his Companions!
